The FDA required the manufacturer to provide that the drug product was being marketed for the public, and the manufacturer was required to submit that the drug was not being used or intended to be used by a person in the drug's package. Therefore, the manufacturer could not have marketed the drug in violation of the "black box" and therefore must have provided the manufacturer with a complete and fair disclosure.
The FDA did not require the manufacturer to provide a complete and fair disclosure of the amount of the drug product, the number of pills in the package, the time, date of administration and other applicable factors and considerations.
